Dialoguing with Hans Joas’ The Sacredness of the Person: A New Genealogy of Human Rights, Stefan-Ludwig Hoffmann’s “Genealogy of Human Rights”, and  Samuel Moyn’s “On the Genealogy of Morals” , I will present my genealogic hypothesis about the constitution of the legal person in the International Law of Human Rights (ILHR). The historical moments chosen to elaborate the “road map” of this genealogy are the first documents of:

 

  1. International Humanitarian Law (Convention for the Amelioration of the Condition of the Wounded in Armies in the Field, 1864),

2.    International Refugee Law (Convention relating to the Status of Refugees,
1951
), and

3.    International Law of Human Rights “stricto sensu” (International Convent-
ion on the Elimination of All Forms of Racial Discrimination, 1965)
